California Insurance Law and Litigation for Consumers:
Has your insurer ever denied your claim or canceled your policy? Your insurer owes you a duty of good faith and fair dealing. An insurer that acts unreasonably is liable for damages beyond those recoverable in pure contract disputes. My practice is committed to:

  • Obtaining insurance benefits and other damages for policyholders after coverage for a claim has been wrongfully denied;
  • Redressing post claim underwriting (when an insurer wrongfully cancels a policy as a result of the filing of a claim);
  • Litigating on behalf of policyholders other unreasonable conduct by insurance companies selling long term care insurance, property insurance, disability insurance, health insurance, life insurance, and other types of insurance products.

  • Family Responsibilities Employment Discrimination (FRD) Law and Litigation for Employees
    boomer_morning.jpgMy practice is also committed to protecting employees from discrimination in employment because of family responsibilities for children, disabled family members, elderly family members, and because of pregnancy. While much serious academic research has been done about women facing the “maternal wall” in their career development, as well as maternal profiling, this law applies equally to male employees with caregiver responsibilities. Such potential unlawful activity includes:

  • Denying reasonable leave and flexible time arrangements for caregiving responsibilities as permitted by law or as allowed to other employees.
  • Whether an employer began subjecting women to less favorable treatment soon after it became aware that they were pregnant;
  • Whether, despite the absence of a decline in work performance, an employer began subjecting the employee to less favorable treatment after he or she assumed caregiving responsibilities;
  • Whether the employer steered or assigned employees with caregiving responsibilities to less prestigious or lower-paid positions.
